Driver license address

binds: licensed driver · verified Sep 2026

moving from the address named in the licence application or on the licence itself

Who this covers, exactly

A Georgia licence holder who moves from the address named in the application or on the licence must apply to the Department of Driver Services for a licence showing the correct address within the stated period. The same sentence, and the same period, covers a name change by marriage or otherwise. The statute is a single undesignated paragraph -- it has no subsections.

note

Georgia states the non-consequence expressly: failing to change the address does not make the licence invalid. The section carries no fine, no misdemeanor and no suspension for a stale address -- searched for penalty, fine, misdemeanor, punish, fee and violation, all zero. The cost of ignoring it is practical rather than legal: the department writes to the address of record.

If missed

The statute states a non-consequence rather than a penalty: failing to change the name or address does not make the licence invalid. Recorded as a row because the express absence of invalidity IS the finding -- it is what the section says, not a gap in the research. No fine, misdemeanor or suspension appears anywhere in the section. O.C.G.A. s. 40-5-33

Homestead notice

binds: homestead claimant · verified Sep 2026

becoming ineligible for a Georgia homestead exemption, which leaving the home does

Who this covers, exactly

A person granted a Georgia homestead exemption who becomes ineligible must notify the county tax receiver or tax commissioner. Moving out of the home is the ordinary way of becoming ineligible, because the exemption depends on the owner continuously occupying the residence as a homestead. The duty is new: it was added to 48-5-45(b) by 2026 Ga. Laws Act 378, and the codified text still shows the pre-amendment version with no notification duty in it.

If missed

A penalty equal to 50 percent of the tax reduction the ineligible exemptions and credits produced, plus the back taxes and interest, under the new 48-5-51.1(a). Each taxpayer shall be notified in writing of the reasons for the denial or removal, and shall be entitled to appeal the removal of the homestead exemption and the application of penalties in the same manner provided in Code Section 48-5-311.

Part-year tax

binds: departing resident taxpayer · verified Sep 2026

ceasing to be a Georgia resident for income tax purposes during the taxable year

Who this covers, exactly

A person is deemed to continue to be a resident of this state until the person shows to the satisfaction of the commissioner that he or she has become a legal resident or domiciliary of another state AND that he or she does not come within the day-count division: every individual who on income tax day has been residing within this state for 183 days or part-days or longer, in the aggregate, of the immediately preceding 365 day period. Upon such a showing with respect to any 12 month period immediately preceding income tax day, the person shall be taxable as a resident of this state only to the date of becoming a nonresident on an apportionment basis as prescribed in Code Section 48-7-85. Conditions and exceptions: whenever the commissioner in his discretion determines that a person is not liable for the tax for an entire year because of moving out of the state, he may prorate the amount of the tax due the state; the commissioner in his reasonable discretion shall be the sole judge as to when that Code section shall apply.

note

Apportionment is not automatic and is not yours to elect. On a successful showing you are taxable as a Georgia resident only up to the date you became a nonresident, on an apportionment basis. But 48-7-85 gives the commissioner discretion, not you a deadline: he "may prorate" the tax, "may require" you to prorate exemptions, and "shall be the sole judge as to when this Code section shall apply". Fail to make the showing and the deeming simply continues.

If missed

There is no penalty for failing to make the showing. The consequence is simply that the deeming continues: Georgia goes on treating the person as a resident for income tax purposes, and the apportionment to the date of becoming a nonresident never becomes available. O.C.G.A. s. 48-7-1(10)(B)

Insurance lapse

binds: vehicle owner · verified Sep 2026

leaving Georgia while a Georgia vehicle registration remains open

Who this covers, exactly

Two separate schemes, and the gap between them is what catches people who move. The insurance duty in 33-34-4 is conditioned on OPERATING the vehicle -- stop driving it and the duty stops biting. The lapse machinery in 40-2-137 is conditioned on the REGISTRATION: insurers report terminations to the department electronically, and the department acts on whatever its records show, whether or not anyone is driving. So cancelling the policy on a car that still holds an open Georgia registration starts the machinery even though no one is operating it. Georgia supplies the exit: a registrant may voluntarily cancel the registration, and the commissioner may waive the lapse fee for an owner who did.

The registration must be voluntarily cancelled before, not after, the insurance is cancelled -- the waiver in 40-2-137(f)(1) is written for an owner whose registration "has been voluntarily canceled", past tense.

Sequence

This duty follows the vehicle registration being voluntarily canceled. Proof: the registration record of the voluntarily canceled registration. O.C.G.A. s. 40-2-137(f)(1)

If missed

On a reported termination the department sends a notice, and it is then the owner's duty to obtain coverage and the insurer's to prove it within the statutory window. Lapse fees follow, escalating with prior lapses inside a five-year window; a second suspension inside five years suspends the registration by operation of law and a third revokes it. A county tax commissioner may waive a lapse fee on proof that no actual lapse occurred.

On a second suspension within a five-year period of a prior one, the department suspends the vehicle registration by operation of law. A third or subsequent suspension in the same window revokes it. Neither step requires a hearing or a decision -- the statute says the department acts by operation of law. O.C.G.A. s. 40-2-137(e)(3)

A void certificate or title shall be surrendered to the department within 15 days from the date that it becomes or is declared to be void.

If missed

The section states the voiding and the surrender duty; it does not attach a separate penalty to a late surrender, and none is asserted here. Peach Pass account

binds: toll account holder · verified Sep 2026

any change to the information previously provided for the vehicles associated with a Peach Pass account, including address, name, card and vehicle information

Who this covers, exactly

Holder of a Peach Pass account whose account information changes on relocation. s. 2.2 enumerates credit/debit card number and expiration date, name or address changes, and vehicular information changes (make/model, license plate information). An interstate move changes at least the address and, once the vehicle is re-plated, the licence plate information -- two of the enumerated classes, three where the card also changes. The duty is conditioned on the next use of a toll facility, not on the move.

Where this applies

State Road and Tollway Authority (SRTA), operating Peach Pass. Contractual duty arising from the Customer Agreement, not from the Georgia Code -- no Georgia statute was located that either imposes or negates a toll-account duty.

If missed

Failure to update is stated to risk a Toll Violation, which Attachment A prices at an administrative fee of $25.00 per violation. Where the toll and that fee go unpaid and the matter reaches the Office of State Administrative Hearings, a further civil penalty of $70.00 per violation is available under O.C.G.A. s. 32-10-64(c)(1). The agreement carries heavier consequences elsewhere -- collections referral, credit-bureau notification, joint-and-several liability across registered owners -- which are not asserted on this obligation because they attach to unpaid balances rather than to stale information.

$25 per violation An administrative fee for a Toll Violation. s. 2.2 states that failure to update account information may result in a Toll Violation; Attachment A prices the administrative fee for one at $25.00 per violation, and the FAQ states the same figure in prose. The agreement states no mechanism connecting stale information to a violation, and none is asserted here. Peach Pass Customer Agreement (SRTA), s. 2.2

$70 per violation A civil penalty under O.C.G.A. s. 32-10-64(c)(1), stated by Attachment A at $70.00 per violation. It is not automatic: the FAQ states it arises where the toll and the statutory administrative fee go unpaid AND the matter is brought before the Office of State Administrative Hearings. Attachment A prices it without stating that condition, so the condition is taken from the FAQ. Peach Pass FAQ

Each of these is a claim commonly made about leaving Georgia. Each was checked against the provision named with it, and is not there. The finding is bounded by that provision and says nothing about the rest of Georgia law.

not a duty · verified Sep 2026

Not in the cited law: that Georgia licence plates must be handed back when the owner leaves the state

What the cited law does instead. What exists is a surrender addressed to someone else entirely. The registration chapter commands owners to REGISTER and to obtain a plate; the single surrender clause in that requirement is aimed at a lienholder or transferor and fires before the sale of a repossessed or involuntarily transferred vehicle, not on anyone moving away. Alongside it sits an option rather than a duty: a registrant MAY voluntarily cancel a registration when the vehicle is not in use, for any reason. Departure appears nowhere in the requirement.

Not in the cited law: that leaving Georgia starts a clock to file an out-of-state address on a Georgia vehicle registration

What the cited law does instead. What exists is a correction affidavit, not a move report. The tag-and-title rules supply an affidavit for correction of address on a licence plate, registration certificate or title that is IN ERROR, and the form "may be obtained" from the Department of Revenue or any county tag agent. Its trigger is a document that is wrong, not an owner who has moved, and it is permissive throughout. Georgia's registration clock runs on ARRIVING with a vehicle and is carried by the entry-side duty; nothing in the registration chapter starts a clock on leaving, and nothing requires an out-of-state address to be filed on a registration that stays open.

Not in the cited law: that Georgia identification card holders carry the same address-change duty as driver licence holders

What the cited law does instead. What exists is a data field, not a duty. The identification card section lets the department print an address of residence on the card and lists what an application must contain, but it places no obligation on the holder to keep that address current -- the section never uses the words change, notify, report or move at all, and states no period of any kind. The only credential a card applicant must hand in is any other licence or card they already hold, at the moment of applying. The Department of Driver Services nonetheless publishes the driver licence interval as though it reached card holders too; that is the department's own statement and not the statute's.

Not in the cited law: that a Georgia weapons carry licence must be surrendered or updated when the holder moves out of state

What the cited law does instead. What exists is replacement machinery, and only that. The licence is expressly authorised to keep working notwithstanding a change in the holder's county of residence or state of domicile, so domicile is a condition of issuance rather than a continuing requirement, and relocation is not among the grounds on which the licence can be revoked. A holder who has had a name change or an address change MAY petition for a replacement licence, and the mandatory language in that provision runs to the probate judge who issues it, not to the holder. The old licence goes back only once the replacement has actually been issued and received.

Not in the cited law: that leaving Georgia creates a title ad valorem tax duty, or entitles the departing owner to a refund of tax already paid

What the cited law does instead. What exists runs the other way: a relief provision for coming BACK. Moving out of Georgia appears once in the whole title ad valorem tax section, and it appears there as a condition inside a list of transactions carrying no tax liability -- someone who paid the tax, later moved away, and then returns and applies to retitle the same vehicle owes nothing further on that retitling. The operative event is the return and the retitle application, not the departure. The section imposes the tax on an arriving owner registering a vehicle formerly registered elsewhere, and says nothing at all about what leaving costs or refunds.

(I) The obtaining of a title by a person who pays state and local title ad valorem tax fees on a motor vehicle and subsequently moves out of this state but returns and applies to retitle such vehicle in this state;

not a duty · verified Sep 2026

Not in the cited law: that a Georgia voter must cancel their registration when they move to another state

What the cited law does instead. What exists is an option for the voter and a duty for everyone else. An elector MAY request removal from the list of electors by writing to the registrars of their county, and on receiving such a request the registrars must remove the name and confirm it by mail. Separately, when an elector moves away and registers to vote in the new state, it is the registration officials there, the Secretary of State and the county registrars who act -- the departing voter's move is recited as the fact that starts an official's process, never as something the voter is commanded to do. A voter who does nothing remains in compliance with this section.
